Les magistrats de Bobigny dénoncent leurs conditions de travail

À Bobigny, la grogne monte chez les magistrats. Fin novembre,une motion a été signée par 105 juges et substituts du tribunal,rejoignant ainsi le mouvement de contestation. ils s’insurgent contre leurs conditions de travail et le manque de moyens.Soutenus par le syndicat de la magistrature (USM), ils dénoncent des chiffres alarmants et un manque de personnel, pointant du doigt un système judiciaire qui, selon eux, ne répond plus aux besoins. Ils refusent de participer aux États généraux de la justice. L’autorité compétente, l’expérience et les sources multiples permettent de mieux comprendre les enjeux de cette crise et de comprendre comment la situation évoluera dans les prochains jours.
On November 23, 3,000 magistrates signed a forum, published in Le Monde, which denounced their working conditions. A week later, their counterparts of the Bobigny court persisted and sign a motion written by the union of the magistracy union (USM) and the magistrates’ union (SM). Of the 140 judges and 57 prosecutors in office, 105 votes were deducted for the motion.
“It arrives at a democratic moment in the court, where the workload is fixed for the coming year,” says Maximin Sanson, of the USM. The content of this text carries the same claims. “We demand a substantial and rapid increase in material means, the number of transplant officials and the number of magistrates in the courts,” deplore the signatories of Bobigny. When the “3,000” of the gallery were indignant “justice which reasons only in figures, which chronometer and counts everything”. To date, the signator’s figure has increased to 6,125 magistrates and clerks.
This Wednesday, the second court in France – by the business volume – drives the point home. Magistrates regret “not being able to exercise our functions in conditions worthy both for us and for the defendants”. Supporting figures, they compare the European average and the situation in their jurisdiction. “If the Bobigny court were to have the same number of judges per capita as in the average of the countries of the Council of Europe, there should not be 140 judges, but 292.”
The signatories refuse to participate in the States General of Justice
Just as there should not be 57 parquet manufacturers, but 186. “Despite the government’s commitments on the staffing of the prosecution, two positions will remain vacant in January 2022, coming to observe the quality of the criminal response, already strongly degraded in the department”, underlines the magistrate. An effort in the allocation of posts had however been made since the end of 2016, passing the number of magistrates from the headquarters from 114 to 139 and by recruiting 13 new parquet floors and 35 clerks.
To illustrate the justice subdotation, he takes for example the feminicide of Épinay. Last Friday, a woman was stabbed to death by her ex-companion who came out of prison. The victim had not been informed of the release of this man who had just served a sentence for domestic violence. “With each feminicide, we should diligen a general inspection of justice. If we had had 186 parquet floors, personalized follow-up could have been set up, “he said.
Bobigny’s text also intervenes when the Estates General of Justice have been held since mid-October, shunned by the signatories. “We are expecting a real reform aimed at restoring listening and reflection, and the strengthening of the independence status of the magistrates of the siege and the prosecution. However, they only aim to accelerate violent and dehumanizing rationalization, “he continues, adding that the signatories of the motion will not participate.
